Suspension of indictment (testifiers)
- Suspension of indictment refers to a disposition by which a case is suspended because the investigation cannot be completed due to reasons such as the suspect??s unknown whereabouts, until the time that the reason for the inability to complete the investigation is resolved.
- Suspension of testifiers refers to a disposition by which a case is suspended because the investigation cannot be completed due to the unknown whereabouts of the testifiers, accusers, and/or reporters in a case, until the time that the reason for the inability to complete the investigation is resolved.
- The investigation shall resume upon the resolution of the reason for the inability to complete it, but if, after the above disposition, the effective period for prosecution service has expired, the case shall be raised again so as to be disposed as one with no right of arraignment.
- In the event that suspension of indictment is decided due to the suspect??s unknown whereabouts, the suspect, in principle, shall be requested to appear at the law enforcement agency, and the suspect??s failure to do so may constitute a claim for an arrest warrant.
